Terms of Sales
Article 1 – Scope
These general conditions of sale (hereinafter referred to as the “General Conditions”) apply without restriction or reservation to all sales concluded between the company Tanit Moroccan Ceramics, the seller with a capital of 1,000,000 argentinian pesos, whose head office is located at 439 Ayacucho St. – Villa Carlos Paz – Cordoba, and any user (hereinafter the “Client”) of the site www.tanit.ar (hereinafter after the “Site”) wishing to make a purchase.
These General Conditions of Sale are accessible at any time on the Site and will prevail, if necessary, over any other version or any other contradictory document.
These general conditions of sale may be subject to modifications.
Tanit reserves the right to modify its general conditions of sale at any time without prior notice to the Customer. The modified general conditions of sale are enforceable against the Customer from and for the duration of their online publication for products ordered after their online publication.
Each purchase on the Site is subject to all the clauses of the general conditions of sale applicable on the date of placing the order. The Customer will only be able to validate his order after having read these general conditions and having accepted them by ticking the box dedicated to this purpose.
Tanit considers that by validating his order, the Customer has duly read the general conditions of sale and accepts them without reservation.
The conditions applicable and opposable to the Customer are those in force at the time of the effective validation by the Customer of his order registered on the Site.
These general conditions of sale apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or through other distribution and marketing channels.
ARTICLE 2 – Object
The Site allows “Tanit” to offer for sale handicrafts and decorations and accessories, cosmetics, delicatessen and all objects designated and created by and for Tanit.

These general conditions of sale are therefore intended to govern:

ARTICLE 2-PRODUCTS:
The products offered for sale by Tanit are those that appear on the site, on the day the user consults the site and within the limits of available stocks.
In case of unavailability of one of the products, the buyer will be informed as soon as possible.
The photographs and texts illustrating the products do not enter into the contractual field. If these photographs and/or texts were incorrect, Tanit cannot be held liable for this.
The Seller offers hand-made objects (textiles, ceramics, baskets, baskets, wooden utensils, jewelry, etc.) which may result in the presence of variations in colors, shapes, finishes and discolorations which cannot be considered as defects, since in relation to their artisanal character “hand made” which makes them unique pieces
ARTICLE 3-PRICE:
The prices are indicated in euros all taxes included including VAT and excluding delivery costs which remain the responsibility of the Internet user unless otherwise specified or under special conditions.
The prices indicated take into account the VAT applicable on the day of the order. If the VAT rate were to be modified, these changes could be passed on to the price of the items without the Internet user being notified in advance.
Any order placed on the site and delivered outside Argentina may be subject to possible taxes and customs duties which are imposed when the package reaches its destination. Tanit is not required to verify and inform the buyer of applicable customs duties and taxes.
The prices indicated on the site are guaranteed on the day of the order within the limits of available stocks except for significant changes in charges and in particular VAT, and except for manifest typographical errors or omissions.
The prices indicated do not take into account the shipping costs which will be invoiced in addition and will be specified to the buyer on the order summary form, before final validation of his order.
Tanit reserves the right, which the user accepts, to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of the registration of the order, subject nevertheless to
Article 4 – Procedure and ordering methods
4.1 – Customer Identification
To place an order, the Customer must connect to the Site. The Site is accessible 24 hours a day, 7 days a week, subject to incidents affecting the level of services.
During his first order the customer has the choice between a registration or a direct order without registration. On the occasion of subsequent orders, the Customer may access his account, if he has created one, by entering his username and password.
The Customer is fully responsible for his username and password and undertakes to ensure their confidentiality.
4.2 – Placing the order
The Customer wishing to place an order selects products on the Site. Once the selection has been made, the Customer must click on the validation button. The basket is thus constituted by the Customer.
The ordering process takes place in 4 steps, following the validation of the basket by the Customer:
Order Summary:
The Customer checks the contents of his basket and can, if necessary, modify it, and/or enter an advantage code allowing him to benefit from a current offer on the Site. Prior to the final validation of his order, the Customer has the possibility of making changes when he notices that an error has appeared in the data entry.
Express delivery: The customer will be notified of the delivery method offered to him and the current weight rate from the country of departure. which is subject to the local shipping rates of international carriers such as Colissimo, GLS, DHL etc. Standard Delivery: The customer will be notified of the delivery method offered to him and the weight rate in force from the country of departure. Payment :
Once steps 1 and 2 have been validated, the Customer must select his method of payment, and validate his payment.
Payment for purchases is made at the Customer’s option:
With Paypal checkout: PayPal is a secure means of payment that allows the Customer to quickly pay for his order without sharing his bank details with the seller sites.
It is enough to have indicated them when creating your PayPal account. They are then encrypted and secured once and for all.
If the Customer already has a PayPal account, he can use it on the Site to pay for his purchases quickly and securely.
If the Customer does not have a PayPal account, he can still choose this payment method. When paying for his order, the Customer is directed to a PayPal page where he enters his bank details (and chooses whether or not to create a PayPal account)

Tanit reserves the right to ask the customer to prove his identity, the place of his domicile and the means of payment used. Failing receipt of said supporting documents Tanit reserves the right to cancel any order.
Tanit reserves the right to refuse to honor any order in the event that there is a dispute relating to the payment of a previous order.
confirmation:
The order is firm for the Customer from the validation of his order, subject to the implementation of his “Right of withdrawal” which he can exercise within fourteen (14) calendar days following the date of receipt or the withdrawal of the Order. In the event that this period expires on a Saturday, a Sunday or a holiday or non-working day, it is extended until the first following working day.
The customer who wishes to exercise his right of withdrawal must return the items within the aforementioned period, in their original packaging, complete, new.
The costs of returning items resulting from the exercise of the right of withdrawal are the responsibility of the customer.
Items returned in new condition will be refunded within fourteen days deducted from the first shipping costs payable by the customer who renounces his purchase.
The products must be returned to the following address CORREO ARGENTINO Sucursal Villa Carlos Paz – 5152 – Cordoba – Argentina.
The validation of the order by the Customer and the payment thereof lead to the receipt of a confirmation email sent by Tanit to the email address indicated by the Customer.
The data communicated by the Customer and recorded by Tanit when registering the order constitutes proof of the transactions between the Customer and Tanit.
4.3 – Order tracking and delivery
The Customer chooses a Delivery address necessarily located on U.S. territory or abroad. The Customer is solely responsible for a lack of delivery due to a lack of indication when placing the Order.
The seller will provide him with a tracking number that will allow him to follow the progress of his order.
The amount of the Delivery Costs depends on the amount of the Order, the country, and the delivery method chosen by the Customer. In any case, the amount of the Delivery Costs is indicated to the customer before the validation of the Order.
Delivery times may vary depending on the availability of the goods ordered.
Delivery times are expressed in working days and correspond to the average preparation and delivery times of the Order in the territory.
Delivery times run from the date of Confirmation of the Order by the Seller.
In the event of late delivery, the order is not cancelled.
The Seller informs the customer by e-mail that the Delivery will take place with a delay. The customer may then decide to cancel the order and will send the Seller a notice of cancellation of the order by email.
In the event that the order has not yet been dispatched when the Seller receives the Customer’s notice of cancellation, the delivery is blocked and the Customer is reimbursed for any sums debited within fourteen days of receipt of the notice of cancellation. In the event that the Order has already been shipped when the Seller receives the Customer’s notice of cancellation, the Customer may still cancel the Order by refusing the package. The Seller will then reimburse the sums debited and the return costs paid by the Customer within fourteen days of receipt of the return of the refused package, complete and in its original condition.
Delivery To Argentina:
The delivery is ensured by the competent services of the company Correo Argentino.
Except in cases of force majeure, delivery times will be within the limits of available stocks, from 24 to 72 hours after validation of the order. The responsibility of the company “Tanit” can not be held liable in the event of late delivery, for any reason whatsoever. Consequently, no claim for compensation, of any nature whatsoever, can be claimed by the Internet user.
Tanit reserves the choice of the carrier and guarantees the correct delivery of the products. The risks of transport are the responsibility of the Internet user from the exit of the product from the warehouse.
The Internet user is required to check the condition of the packaging and the conformity of the product delivered, and to make any reservations on the carrier’s delivery note, if any.
Home delivery is not guaranteed for all cities in Argentina.
Delivery in U.S.A. and rest of the world:
Tanit will make its best efforts to ensure that the order is prepared and delivered to the carrier within an average of one (2) to five (10) working days from the day following that of the validation by the buyer of his order.
The distribution of the parcel is done against signature of the recipient. In case of absence, a notice is left to the recipient either by email or by telephone. From the date mentioned on the transit advice note, the recipient has 15 days to collect his package from the carrier’s offices.
Delay / non-delivery:
We work with fast and reliable international carriers, however, as with any shipment, there may be a delay in delivery or the product may get lost. In case of late delivery, the customer must inform Tanit customer service. This information can be done by email to contacto@tanit.ar Tanit will send the information to the carrier to trigger the opening of an investigation. This investigation can last up to 21 days from its opening. If during this period, the product is found, it will be immediately redirected to the Buyer’s home (in the majority of cases). If, on the other hand, the product is not found at the end of the 21-day period of investigation, the carrier considers the package as lost. In this case, Tanit will send you a replacement product, at its expense. If the lost product(s) were no longer available at that time, Tanit would refund the amount of these products. Tanit declines all responsibility for the extension of delivery times due to the carrier, in particular in the event of loss of products or strikes.
Receipt of order :
Upon receipt of the order, the Buyer will check the conformity of the Products received in execution of his order. Any anomaly concerning the delivery (damage, non-conformity, missing product compared to the delivery note, damaged package, broken products, etc.) must be indicated on the delivery note in the form of “handwritten reservations”, accompanied by the signature of the Buyer. The Buyer must also confirm this anomaly by contacting the carrier at the time of delivery. The Buyer must send a copy of this letter by e-mail to contacto@tanit.ar
Except for legitimate reasons, any claim not brought to the attention of Tanit within 21 days of receipt of the Products will be considered inadmissible, and Tanit cannot be held liable.
Tanit reserves the right to ask the Buyer to return the non-compliant or damaged Product.
In the event of abnormal or abusive returns, Tanit reserves the right to refuse to honor a subsequent order.
ARTICLE 5 – PROTECTION OF PERSONAL DATA:
Tanit undertakes not to communicate the personal data (name, address, telephone, email, etc.) or those relating to the payment which will have been provided to it to any companies or third-party organizations whatsoever except in the following cases:
- In the case of the fight against internet fraud
- As part of the associated services chosen by our customers (delivery, etc.) to facilitate a transaction or to resolve a possible dispute.
- In the event that Argentinian law requires it.
- To respond to an injunction emanating from a court decision or legal authorities. By accepting the general conditions of sale, customers give their consent to the use, by lesmarrisiennes.com, of the personal data concerning them.
In order to provide a service that meets the needs of its customers, Tanit may collect data relating to the reputation and use of its own services. This data will then only be used on an anonymous and aggregated basis.
Tanit may be required to use the appropriate technical means allowing it to personalize its services.

ARTICLE 6 – INTELLECTUAL PROPERTY:
All elements of the Tanit site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.
They are the exclusive property of Tanit . The Internet user who has a personal website and who wishes to place, for personal use, on his website a simple link directly to the homepage of the Tanit website, must request authorization from the company. Tanit .

ARTICLE 7.1 – LIABILITY:
The Tanit Site has, for all stages of access to the Site, the ordering process, delivery or subsequent services, only an obligation of means. The site cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure, in accordance with case law.
Furthermore, Tanit disclaims liability for any breach of its contractual obligations in the event of force majeure or fortuitous events, including, without this list being exhaustive, internal or external strike, fire, disaster, internal or external breakdown. , and any event preventing the proper execution of orders.
If the dispute relates to payment transactions, the banking institution or the third party in charge of the payment system may be consulted.
Tanit retains full ownership of their products sold until full payment of the main price, including fees and taxes.
ARTICLE 7.2 – FORCE MAJEURE:
Tanit will not be liable for the total or partial non-execution of its obligations under this contract, if this non-execution is caused by an event constituting force majeure, recognized as such by case law.
The Parties agree that they must consult together as soon as possible in order to determine together the terms of execution of the order for the duration of the case of force majeure.
Beyond a period of one (1) month of interruption due to force majeure, the parties will be released from their obligations to each other.
ARTICLE 7.3 – PARTIAL NON VALIDITY:
If one or more stipulations of these general conditions of sale are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other stipulations will retain all their strength and scope.
ARTICLE 7.4 – ENTIRE AGREEMENT:
These general conditions of sale and the order summary sent to the buyer form a contractual whole and constitute the entire contractual relationship between the parties. In case of contradiction between these documents, the general conditions of sale will prevail.
ARTICLE 7.5 – APPLICABLE LAW – COMPETENT COURTS:
These general conditions of sale are governed by Argentinian law. For all disputes relating to this contract between Tanit and an Internet user, the Commercial Court of Argentina will have sole jurisdiction.
